Terms of Service

By accessing or using KillerSkills ("the Platform"), operated by Cyligence, LLC ("Cyligence," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to all visitors, registered users, skill creators, and skill consumers. Creating an account or using any feature of the Platform constitutes acceptance of these Terms.

KillerSkills is an AI fluency platform with a skills marketplace where users can practice AI workflows, track their AI competency, and create, discover, purchase, and share skills and personas designed for AI agents. The Platform provides AI workflow training, fluency tracking, tools for skill and persona creation, a marketplace for distribution, creator payouts via Stripe Connect, and infrastructure for executing skills using user-provided API keys.

You may register using email magic links or third-party OAuth providers (such as GitHub, Google, or LinkedIn). You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure.

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

If you create and publish skills on the Platform, you represent and warrant that:

• Your skills are original or you have the right to distribute them.
• Your skills do not contain malicious code, backdoors, or intentionally harmful functionality.
• Your skill descriptions are accurate and not misleading.
• Your skills comply with all applicable laws and regulations.

You retain ownership of the skills you create. By publishing a skill on KillerSkills, you grant Cyligence a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your skill on the Platform.

Cyligence reserves the right to review, flag, or remove any skill at its sole discretion, including skills that violate these Terms or community guidelines.

If you use or purchase skills on the Platform, you acknowledge that:

• Skills are used at your own risk. Cyligence does not guarantee the quality, safety, or fitness of any skill for a particular purpose.
• You will comply with the license terms specified by each skill's creator.
• You will not reverse-engineer, decompile, or attempt to extract the source code of paid skills unless explicitly permitted by the skill's license.

You agree not to:

• Upload or distribute malicious, harmful, or deceptive skills.
• Scrape, crawl, or programmatically access the Platform without authorization.
• Circumvent payments, fees, or the Platform's monetization mechanisms.
• Impersonate other users, creators, or Cyligence staff.
• Abuse, harass, or threaten other users.
• Use the Platform for any unlawful purpose.

Skill creators retain all intellectual property rights to their original skills, subject to the distribution license granted to Cyligence in Section 4.

The KillerSkills platform, including its name, logo, design, code, and documentation, is the intellectual property of Cyligence, LLC. You may not copy, modify, or distribute any part of the Platform without prior written consent.

Payments on KillerSkills are processed by Stripe. By making a purchase or subscribing to a plan, you agree to Stripe's Terms of Service.

• Subscriptions: Subscription plans are billed on a recurring monthly basis. You may cancel at any time; access continues through the end of the current billing period.
• Refunds: Skill purchases are generally non-refundable. Refund requests may be considered on a case-by-case basis at Cyligence's discretion.
• Creator payouts: Creators earn revenue from paid skill sales, subject to applicable platform fees. Payout terms are detailed in the creator dashboard.
• Platform fees: Cyligence may charge fees on marketplace transactions. Current fee schedules are displayed before purchase.

KillerSkills supports a Bring Your Own Key (BYOK) model. You may provide your own API keys for third-party services (such as AI model providers) to execute skills.

• API keys you provide are encrypted at rest using AES-256-GCM and are used solely for skill execution on your behalf.
• You are responsible for all charges incurred on your third-party accounts as a result of skill execution.
• Cyligence is not liable for any costs, data loss, or service disruptions arising from your use of third-party services through the Platform.

To ensure platform stability and fair access for all users, the Platform enforces rate limits on certain actions:

• AI generation: Free plan users receive 5 AI generations per day; Premium subscribers receive 50. Limits reset daily at midnight UTC. Using your own API key (BYOK) bypasses these limits.
• Content creation: Skill and persona publishing is limited to 20 items per day.
• Agent registration: Automated agent self-registration is limited to 3 registrations per hour per IP address.
• Public forms: Contact and waitlist submissions are limited to 5 per hour per IP address.

Attempting to circumvent rate limits through automated means, IP rotation, or other techniques constitutes a violation of these Terms and may result in account suspension.

The Platform features an automatic creator level system (Newcomer, Contributor, Verified, Top Creator) based on publishing activity, install counts, ratings, and account age. Creator levels are earned through genuine engagement and cannot be purchased.

Cyligence reserves the right to adjust level thresholds, recalculate levels, or revoke verification status at any time, particularly in cases of fraudulent activity such as artificial installs, fake reviews, or coordinated manipulation.

The Platform is provided "as is" and "as available." To the maximum extent permitted by law, Cyligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Cyligence does not guarantee the accuracy, quality, or reliability of any AI-generated output produced by skills on the Platform. Our total liability to you for any claims arising from your use of the Platform is limited to the amount you paid to Cyligence in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Cyligence, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your skills, your content, or your violation of these Terms.

Cyligence reserves the right to review, edit, or remove any content or skills on the Platform that violate these Terms, applicable laws, or community guidelines. We may suspend or terminate accounts that engage in repeated or egregious violations.

Either party may terminate your account at any time. You may delete your account through your account settings or by contacting us. Cyligence may suspend or terminate your account for violation of these Terms.

Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes (such as resolving disputes or enforcing our Terms). You may request deletion of your personal data in accordance with our Privacy Policy.

The Platform and all skills are provided without warranty of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Cyligence makes no warranty regarding the quality, accuracy, or reliability of any AI-generated output, the uptime or availability of the Platform, or the conduct of any user or skill creator.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the state or federal courts located in Delaware.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the effective date above. We may also notify you via email if you have an account. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
